Marco is providing Booking Credits as an easy way to pay for experiences through Marco Experiences. Booking Credits do not expire and can be applied to future experiences booked on the Platform. Booking Credits are not a regulated product.
“Booking Credits” are a store of value input by the Customer which are available to redeem on a later booking. A Booking Credit: (i) is non-refundable and non-transferable; (ii) is not cash, currency or a gift card product; (iii) one Booking Credit is equal to one US dollar ($1.00); and (iv) cannot be redeemed for cash except where required by law. You may not sell, trade, or transfer Booking Credits.
When you sign up with Marco on behalf of your organization or company, you will create a login for your organization or company that allows you to access your Marco Dashboard. Using this Dashboard, you can search and book experiences, view booked experiences, and access your billing information and other account features. In your account you can also designate account Administrators and Users who will have different access and control options.
You purchase Booking Credits at the rate sold by Marco, and these Booking Credits are saved and displayed in your Marco Dashboard under “Billing”. All users on your account will have access to the Booking Credits available in your account. When you wish to book an experience, Booking Credits available in your account will be automatically applied to the experience and will reduce the cost of that booking by the applied amount.
If a booking uses up less than your total available Booking Credit balance, the unused balance will remain on your Dashboard. If an invoice for a booking is greater than the available Booking Credits in your account, the difference will be invoiced to you directly for payment. No fees of any kind apply to Booking Credits, and Booking Credit balances do not expire but may be subject to applicable unclaimed property laws.
If you cancel or modify a booking request that was paid for using Booking Credits in the appropriate and specified windows congruent with Marco Experiences Buyer Terms and Conditions, the Booking Credits used for the experience will be refunded back into your Dashboard as a Booking Credit. Your refund amount will be based on the Host’s cancellation policy for both: (i) any amount paid with your Payment Method (e.g., your credit or debit card), and (ii) any amount paid using Booking Credits, which will then be available on your Marco Dashboard for future use.
Booking Credits may not be applied toward charges for existing reservations. Booking Credits cannot be resold, transferred for value, or redeemed for cash, except to the extent required by law. Once a Booking Credit is claimed by a Customer, its value cannot be transferred to another person or customer. A Booking Credit balance on a Marco Experiences account may not be cashed out or transferred to another Marco Experiences account. Termination of your Marco account by you or by Marco pursuant to its Terms will result in forfeiture of any unused Booking Credits.
If for any reason you believe that there is a discrepancy regarding your Booking Credits, please contact us. Marco may require you to submit additional information in order to make a determination regarding your Booking Credits. The value of your existing Booking Credits will never change, but the types of products and services that the Marco Platform offers and that you may apply Booking Credits to may change over time. Marco also reserves the right to change the value of future Booking Credits before they are purchased by you.
Booking Credits are issued by Marco Experiences, Inc. and can only be used through the Marco Experiences Platform.
Marco may modify these Booking Credit Terms at any time. When we make material changes to these Booking Credit Terms, we will post the revised Booking Credit Terms on the Marco Platform and update the “Last Updated” date at the top of these Booking Credit Terms. We will also provide you with notice of any material changes by email at least 30 days before the date they become effective. Your continued access to or use of the Marco Platform after the changes to these Booking Credit Terms go into effect will constitute acceptance of the revised Booking Credit Terms.
All terms and conditions are applicable to the extent permitted by law. You understand and agree that you are solely responsible for determining for your jurisdiction (i) the applicable tax reporting requirements, and (ii) the taxes that should be paid in connection with the Booking Credits, if any. Where applicable, Marco may be required to account for VAT on services for which the Booking Credit is redeemed.
In no event will Marco be liable for any special, incidental, punitive, exemplary or consequential damages of any kind even if Marco has been informed in advance of the possibility of such damages. In no event will Marco’s aggregate liability to you in connection with the Booking Credits exceed the amount of your Booking Credits.
Our failure to insist upon or enforce your strict compliance with these Booking Credit Terms will not constitute a waiver of any of our rights.
Marco reserves the right to refuse, void, cancel, reject or hold for review your Booking Credits if we believe that you initiated any fraudulent activity related to the Booking Credit Program.
Any dispute or claim relating in any way to Booking Credits will be resolved in accordance with the Governing Law and Dispute Resolution section of the Marco Experiences’ Terms and Conditions.
